Why use government standard lease templates

Mandated agencies should use government standard lease templates as a starting point to:

  • ensure a consistent approach to lease agreements across agencies
  • ensure clauses unique to government leases are included
  • reduce the risk of the Crown entering into leases with unfavourable terms.

Government standard lease templates are not publicly available. Mandated agencies can access the templates listed below by emailing the Government Property Office team.

You will need to amend the lease templates to reflect your specific deal, including amending details and adding or deleting relevant clauses. Your legal team will need to draft any other non-standard agreements.

Government Standard Development Agreement

Use this Development Agreement template to record the intention to enter into a new lease, before starting any significant fit-out work of new office space.

  • The Development Agreement protects the interests of landlord and tenant during work agreed as part of negotiations, before the Deed of Lease is signed.
  • The landlord is typically responsible for any construction, refurbishment, or base building works – for example, installing ceiling tiles.
  • The tenant is typically responsible for hard and soft fit-out work – for example, subdivisional partitions and mobile furnishings.
  • The Development Agreement records the scope of these responsibilities as agreed between tenant and landlord.

Government Standard Agreement to Lease (ATL)

Use this template to record the intention to enter into a new lease where little or no building works are required.

  • The Agreement to Lease records both parties' agreement to enter into a new lease at a future date.
  • It is suitable where only minimal works are required by either landlord or tenant.
  • It provides certainty for landlord and tenant until the Deed of Lease can be signed.

Government Standard Deed of Lease – Complex (Gross)

Use this template where:

  • an agency is entering into a lease of the whole or a substantial part of a large or complicated building (or complex of buildings) for a lengthy fixed period, or
  • the premises are of particular strategic importance to the tenant (for example, head office accommodation for a large or essential government entity, or premises where security is particularly important).

Government Standard Deed of Lease – Less Complex (Gross)

Use this template where your agency is leasing smaller premises, or a straightforward or less strategically important building.
